TERMS OF USE & COMPETITION RULES

Thank you for interest in the Light World Tour and for visiting www.lightworldtour.com, (“Website”). The Website and the Light World Tour are offered to you by Philips Lighting B.V., hereafter “Philips” (for more information on Philips and contact details, please see the About Us section of these Terms of Use). On the Website you will find lots of information, photos and videos from Philips about the Light World Tour (“Content”). 

We encourage you to participate in the Light World Tour Competition (“Competition”) by submitting your unique photo(s) and /or video(s) of a light design inspiration and complete the sign up- form on the Website. Also people who are inspired by lighting, but do not want to participate in the Competition (and therefore will not have a chance of winning the prize of a three month tour around the world) are invited to share their visual inspiration for other lighting professionals and enthusiasts on the Website.  Your uploaded photo(s) and any other content like reviews, questions, comments, information, videos and the like shall hereafter be referred to as “User Generated Content”.

Please be informed that your use of the Website and participation in the Competition is subject to your acceptance of the following terms and conditions (“Terms”). The Terms consist of:

A) Terms for Use;
B) Privacy Notice;
C) Competition Rules;
D) About us.

Philips shall review all Content and User Generated Content on the Website. All User Generated Content which is inappropriate or offensive shall be removed. Please understand that User Generated Content, posted to the Website does not represent the ideals and opinions of Philips, its affiliated companies or its employees.

A) Website Terms of Use for www.lightworldtour.com, and all sub-pages

These terms and conditions of use ("Terms of Use") apply to all visits to and all use of the Website, as well as to all Content and User Generated Content provided to you on or through the Website. By using the Website you agree to the applicability of these Terms of Use. We note that these Terms of Use may be changed over time. Such changes shall be effective immediately upon the posting of the modified Terms of Use. Users of the Website are advised to regularly read the Terms of Use for possible changes.

Content and Liability.

Philips tries to provide you with content as accurate as possible, however Philips: (a) does not represent or warrant the accuracy of any statement or product claims made on the Website; (b) is not responsible for any User Generated Content on the Website;  (c) does not endorse any opinions expressed on the Website. All Content and User Generated Content is provided "as is" and Philips does not accept any responsibility for any loss, injury or inconvenience resulting from the Content or User Generated Content.

Philips shall not be liable for any damages resulting from the use (or inability to make use) of the Website, including damages caused by viruses or any incorrectness or incompleteness of the Information, unless such damage is the result of any wilful misconduct or gross negligence on part of Philips. Philips shall not be liable for damages resulting from any lack of suitability, timeliness or accuracy of this Website or the Content or User Generated Content.

Philips shall further not be liable for damages resulting from the use of electronic means of communication, including, but not limited to, damages resulting from the failure or delay in delivery of electronic communications, interception or manipulation of electronic communications by third parties or by computer programs used for electronic communications and transmission of viruses.

Hyperlinks.

Hyperlinks on the Website may direct users to external websites which are maintained by third parties. Philips shall not be liable for the contents and the functioning of such external websites. Philips shall also not be liable for the quality of products or services which may be offered on such external websites.

Intellectual property.

Unless indicated otherwise, all intellectual property rights to the Website and the Information are owned by Philips. Philips's rights include but are not limited to all copyrights, rights to the trade names, word trademarks, pictorial trademarks and logos of Philips. 

Users are permitted to read the Website and the Information and make copies for their own personal use, for example by printing or storing. All other use of the Website, Content or the User Generated Content, for example the storage or reproduction of (a part of) the Website of Philips in any external internet site, is prohibited without the express written consent of Philips.

Posting and/or uploading of stories and/or materials.

In the event that you post or upload User Generated Content on the Website or send such User Generated Content to Philips by email or otherwise, Philips shall be entitled to use, copy and/or commercially exploit such User Generated Content to the fullest extent and free of charge. Philips shall not be bound by any confidentiality obligation in respect of such User Generated Content.

All User Generated Content that you upload to the Website, as well as any other activity by you on the Website, must not:

• be false, inaccurate or misleading;
• be in breach of any applicable laws, regulations, licences, or third party rights;
• be harmful, threatening, defamatory, infringing, harassing or racially or ethnically offensive;
• facilitate illegal activity;
• depict sexually explicit images;
• promote violence;
• be discriminatory based on race, gender, colour, religious belief, sexual orientation and/or disability;
• cause damage or injury to any person or property; or
• interfere in any way with the proper working of the Website and in particular you must not circumvent security, tamper with, hack into or disrupt the operation of the website, or surreptitiously intercept, access without authority or expropriate any system, information or personal data.

Philips will report any such offences to the relevant law enforcement authorities and will co-operate with those authorities, amongst others by disclosing your identity to them. Philips reserves the right to disclose your identity to any third party claiming that the User Generated Content posted or uploaded by you to our Website violate their intellectual property rights or their right to privacy.

You warrant that any contribution to this Website on your part complies with the above standards. You indemnify and hold Philips harmless from and against all actions, claims and liabilities, suffered, incurred or sustained by Philips as a result of the use and/or exploitation of the User Generated Content infringing the (intellectual property) rights of any third party or otherwise being unlawful towards a third party.

Philips reserves the right to remove User Generated Content you make on our Website if, in the opinion of Philips, such User Generated Content or postings do not comply with the standards set out above.

Severability.

If these Terms of Use are or become partially void, the parties will continue to be bound by the remainder of the same. The parties shall replace the void part be provisions that are valid and have legal effect that correspond with those of such void part as much as possible, taking into account the content and the purport of these Terms of Use.

Applicable law and jurisdiction.

These Terms of Use shall be exclusively governed by Dutch law. All disputes arising in connection with these Terms of Use, including but not limited to disputes concerning the existence and validity thereof, shall be resolved by the competent courts of Utrecht, the Netherlands.

B) Privacy Policy

Philips will not collect any personal information from you through the website and/or participation in the Competition, other than the personal information you provide Philips with when you submit an entry form for participation in the Competition (your name, country and email address).

Philips will use such personal information only to contact you per email, to inform you about the Competition. Philips shall delete the personal information as soon as the Competition has been completed and the winner has been selected. Philips shall not sell, distribute or otherwise share the personal information with third parties, unless required for the execution of the Competition. Other than the aforementioned use of your personal date, Philips shall only use your personal date in accordance with the Philips Privacy Policy (click for a link).

C) Competition Rules

On the Website Philips will organize a Competition for professionals, with an interest in the creative use of lighting, lighting design and architectural lighting. The winner of the Competition will go on a 3 month sponsored tour around the world in search of inspirational lighting and take the rest of the lighting community and enthusiasts along for the ride. The Light World Tour traveler will be travelling and staying in a dozen or so cities over three months, seeing all the local sights, dropping in on events and hitting up the best that each city has to offer in light. Keeping the rest of the world inspired with plenty of videos and pictures of his or her adventures on the blog.

If you wish to participate in the Competition than the following Competition rules (“Rules”) shall be applicable on your participation in the Competition:

How to join the Competition?
You can participate in the Competition, from June 1st 2011 till August 8th midnight PST 2011]. After last mentioned date participation is no longer possible. In order participate you first have to complete the registration process on the Website. Part of that registration process is that you participant have to upload a unique photo or design that inspires you for a light design with an explanation, to show your knowledge of lighting and lighting design as well as their ability to inspire and engage a community of lighting professionals through words and visuals. The most unique photo or design shall finally be selected as the winner of the Competition.

Selection Process
The selection process comprises of two phases, the first phase is the voting phase. Everyone can vote for its favorite participant on the Website. You can increase your chances of winning the Prize by informing your social communities, friends, relatives, etc, about your participation in the Competition, and by doing so generating votes on the Website. Furthermore, light professionals and enthusiasts alike will have the opportunity to share inspirational lighting destinations through pictures or videos. Voting is possible from June 1st until August 8th midnight PST.

In the second phase of the selection process, a jury of lighting professionals chaired by Rogier van der Heide (Chief Design Officer and Vice President, Philips) will select the winner out of the top 10 most voted for participants. The Jury shall communicate who the winner is on August 12th 2011.

Prize
The prize includes the tour itself, including all travel needed to visit the destinations in the final Light World Tour itinerary and an allowance for daily expenses. The final itinerary will be created by Philips based on community suggestions. The estimated value of this prize is 10,000 euros. In addition, the winner will receive a fixed fee per month for his coverage of Light World Tour by means of blogs, video-entries, tweets and other posts on Light World Tour and other social media. 13. There may be some tax implications for Prize winners. Participants should review their Application with their legal/tax advisor to determine their potential tax liability, if any, in connection with receiving a Prize as part of this Competition. If there is any tax liability, Philips shall pay the tax to assure that the net Prize remains EUR 10,000.

Additional Rules
1) A purchase of Philips products is not required to participate in the Competition. Participation is free of charge and open: (a) to individuals who are at least 18 years of age, and (b) to individuals who are legal residents of countries that allow participation under their national laws. Participation is void for residents of countries where participation is prohibited.
2) The User Generated Content that you upload or provide to Philips for the purpose of participating in the Competition is regarded as User-Generated Content under these Terms;
3) The Terms and the Philips Privacy Policy applies to all personal information that you provide to Philips for the purpose of participating in the Competition. You also agree that Philips may contact by any means you about the Competition;
4) Prizes awarded are awarded by Philips at Philips’ sole discretion. Prizes may not be exchanged for money;
5) If you fail to comply with any of the Terms or Rules, you will be disqualified from taking part in the Competition;
6) You cannot hold Philips (or any third party acting on behalf of Philips in relation to the Competition liable for any loss, injury or inconvenience resulting from participating in the Competition, or the  (use of) any prize awarded;
7) Your User Generated Content must be original, and not previously proposed, developed or implemented, either in whole or part, by anyone else. Ideas must be implementable within a maximum of two years. It’s the responsibility of the participants to ensure that their idea does not infringe on anyone else’s intellectual property rights;
8) Only those entries submitted and received in good order by Philips before 8 August 2011 at 12AM (midnight) Pacific Standard Time  shall be deemed valid and shall be taken into consideration. Submissions which are incomplete, illegible, lost or damages shall not be taken into consideration. Philips accepts no liability whatsoever for any problems or any deficiency concerning computers, connections or networks used in submitting an entry through the Website;
9) Out of a shortlist of most voted for participatants, one overall winner shall be selected;
10) The winner shall be contacted by Philips, making use of the registration data provided by participant when submitting the entry form;
11) There may be some tax implications for the winner. Participants should review their participation with their legal/tax advisor to determine their potential tax liability, if any, in connection the possibility of winning the Prize;
12) Employees of Philips or associated companies and members of their families are not eligible to win the Prize;
13) The participant agrees that Philips shall be allowed - in its sole discretion - to use the prizewinner’s name and/or image for promotional or advertising purposes related to the Competition.
